Introduction & Acceptance of Terms

Welcome to Deep Data Project. These Terms of Service govern your relationship with our services, which are operated and owned by TTMSYSTEM, spol. s r. o., a company registered in Slovakia with company registration number (IČO): 55308970, tax identification number (DIČ): 2121945617, registered in the Commercial Register of the District Court Trenčín, Section: Sro, Insert No. 44981/R, and registered office at J. Matušku 1994/16, 957 01 Bánovce nad Bebravou (referred to as "Company," "we," "our," or "us").

By accessing or using our website, services, or purchasing any of our digital products, you ("User," "you," "your") agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services or purchase our products.

Description of Service, Intended Audience & Data Nature

Deep Data Project provides premium historical financial data intended strictly for backtesting, quantitative research, and algorithm development. Our products are delivered in the form of a digital download and installation directly into the MetaTrader 5 (MT5) platform.

Professional and B2B Intended Use: Our data products are highly specialized and designed primarily for developers, automated trading businesses, and individuals acting in a professional or advanced quantitative research capacity. If you access or purchase our services as a consumer (a natural person acting for purposes outside of your trade, business, craft, or profession), you agree that our digital content is delivered immediately upon purchase, and you must comply with the express waiver of the right of withdrawal as detailed in Section 4.

Inherent Characteristics of Historical Financial Data: You acknowledge and agree that historical financial data by its very nature is never 100% complete, flawless, or free of discrepancies. Due to differences in broker feeds, liquidity gaps, server downtimes, spread fluctuations, market closures, and technological limitations, some data points, price ticks, or historical candles may be missing, incomplete, or vary from other sources. You are specifically informed of these natural characteristics and minor discrepancies prior to your purchase. By completing a transaction, you:

  • expressly acknowledge and agree that such minor data gaps, broker feed variations, or missing candles are normal, expected, and statistically standard characteristics of historical backtesting data;
  • agree that these discrepancies do NOT constitute a defect, a lack of conformity, or an error of the digital content; and
  • expressly and separately accept these deviations from any objective conformity requirements under applicable laws (including Slovak Act No. 108/2024 Coll. / Civil Code Act No. 40/1964 Coll. and EU Directive 2011/83/EU / 2019/770).

Intellectual Property & License to Use

All data, software, and content provided by us are protected by copyright and intellectual property laws. Upon purchase, we grant you a personal, non-transferable, and non-exclusive license to use the data strictly for your own private or internal business purposes (e.g., backtesting your personal strategies).

Strict Prohibition of Redistribution: You are strictly prohibited from copying, sharing, forwarding, reselling, renting, or otherwise distributing the data or our software (whether for free or for commercial gain) to any third parties. Any unauthorized distribution or sharing of our proprietary data will result in immediate termination of your account without notice or refund, and we reserve the right to pursue legal action for damages.

All exported data is protected by a unique digital watermark linked to your license. Sharing files with any third party will result in immediate account termination and legal action to recover damages.

Refund & Return Policy (All Sales Are Final & Waiver of Withdrawal Right)

Due to the nature of our products as immediately accessible digital goods (digital content not delivered on a tangible medium), all sales are final and non-refundable.

For EU and Slovak Republic Consumers: Pursuant to Slovak consumer protection laws (including Act No. 108/2024 Coll. on Consumer Protection, and previously Act No. 102/2014 Coll.) and the EU Consumer Rights Directive (2011/83/EU), consumers ordinarily have a 14-day right of withdrawal from distance contracts. However, this right does not apply to the supply of digital content not delivered on a tangible medium once the performance has begun. By purchasing and downloading, installing, or accessing our data packages or software, you:

  • give your prior express consent to start the delivery of the digital content immediately upon completion of the transaction (before the expiration of the statutory 14-day withdrawal period); and
  • expressly acknowledge and agree that by giving this consent and starting the download/performance, you lose your right of withdrawal from the contract and lose any right to a refund, return, or exchange.

For all other users, we do not offer refunds under any circumstances, including but not limited to dissatisfaction with the data, inability to properly configure your trading platform, or accidental purchases.

Disclaimer of Warranties & Limitation of Liability

We provide historical data for backtesting and research purposes only. We do not provide financial advice, trading recommendations, or trading systems.

Except as specifically described in Section 2 regarding the inherent nature, broker discrepancies, and natural gaps of historical data (which you have been specifically informed of and have expressly and separately accepted), the digital content is provided without any other express or implied warranties. We do not warrant that the data matches every external broker feed or is 100% uninterrupted. We are not responsible for the performance, errors, or failures of your trading robots (Expert Advisors) or manual strategies.

Slovak & EU Law Consumer Conformity Compliance: Under the consumer protection provisions of the Slovak Civil Code (Act No. 40/1964 Coll., as amended by Act No. 108/2024 Coll.) transposing Directive (EU) 2019/770, you acknowledge that you have been specifically informed about and have separately accepted the deviation of the digital content from objective conformity requirements (as detailed in Section 2). Therefore, such minor gaps or natural market anomalies do not constitute a defect (lack of conformity) and cannot be claimed as faulty performance or used to demand a price reduction or contract withdrawal.

Financial Risk Warning: Trading in financial markets involves substantial risk. You agree that we shall not be held liable for any direct, indirect, or consequential financial losses, damages, or lost profits arising from your trading decisions or the use of our data in live market environments.

User Accounts, Security & Privacy

You are responsible for maintaining the confidentiality of your account credentials. Sharing your account or login details with others is strictly prohibited and constitutes a violation of these Terms. Your personal data is processed in accordance with our Privacy Policy, which is accessible on our website and outlines your rights under the GDPR and applicable data protection laws.

Governing Law, Supervisory Authority & Alternative Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Slovakia, without regard to its conflict of law provisions.

Supervisory Authority: The competent supervisory authority for consumer protection is the Slovak Trade Inspection (Slovenská obchodná inšpekcia - SOI), Inspectorate of SOI for the Trenčín Region, Hurbanova 59, 911 01 Trenčín, Slovakia.

Alternative Dispute Resolution (ADR): If you are a consumer and are not satisfied with the way we handled your complaint or believe your rights have been violated, you have the right to initiate an alternative dispute resolution procedure. You can submit a request through the European Online Dispute Resolution (ODR) platform available at: http://ec.europa.eu/consumers/odr/ or directly to the Slovak Trade Inspection.
